Punitive Damages
Clear and convincing evidence must be presented to prove that defendant is guilty of oppression, fraud, or malice, express or implied.
Caps: Three times compensatory damages if damages exceed $100,000 or, if compensatory damages are less, no more than $300,000 but does not apply in products cases. Numerous other statutory limitations apply.

Comparative Negligence
Applies only if plaintiff’s fault is 50% or less, and plaintiff’s recovery is diminished by degree of fault.
Damages
Medical malpractice pain and suffering limited to $350,000 unless gross malpractice or exceptional circumstances. Damages limited to insurance coverage.
Medical Malpractice
4 years after date of injury and 2 years after date of discovery if occurring before 10/1/02, 3 years if occurring after 10/1/02. Statute tolled during period where action is pending before medical malpractice screening panel.
Disabilities
Medical malpractice action must be brought by parent, guardian, or legal custodian. No toll except in case of brain damage or birth defect, then SOL extended until child is 10, or in case of sterility, 2 years from discovery. For sexual abuse of a minor, 3 years from 18th birthday or discovery, whichever is later.
