Assault and Battery

Assault and battery are intentional torts.  In a civil case, the prima facie requirements of intentional torts are an intentional act and causation.  This means that the aggressor must have intended to act in a certain way that caused the victim's injuries.

The black letter definition of a battery is an intentional touching of a plaintiff's person that is offensive to an average person.  An assault occurs when a person places another person into a reasonable apprehension of harm so that the injured person knows that he/she is in a reasonable apprehension of harm.
